I dare not ask for leave

Since the introduction of the three child policy in August last year, all localities have successively started the revision of local population and family planning regulations, intensively introduced measures to encourage fertility, and the addition or extension of male paternity leave is one of them. Although some employees know that the unit has paternity leave, they are worried about affecting their work and choose endlessly, and the proportion reaches 64.53%.

In the interview, many male employees said that they did not dare to ask for paternity leave and chose to take annual leave, personal leave and overtime to accompany their wives and babies. “When a daughter-in-law is in confinement, even if there is a sister-in-law, there must be someone at home to coordinate. Who will pay for the holiday

In Shen Jianfeng’s view, one of the reasons why employees dare not ask for leave and enterprises are unwilling to approve lies in “who pays the salary during the holiday”.

According to the special provisions on labor protection for female employees promulgated by the State Council, the maternity allowance for female employees during maternity leave shall be paid by the maternity insurance fund according to the standard of the average monthly salary of employees of the employer in the previous year.

“Men’s wages for paternity leave are paid by enterprises. The burden of enterprises increases, and male workers’ enthusiasm for paternity leave will also decrease.” Shen Jianfeng said.

On March 7, Haidian District People’s Court of Beijing issued a legal case related to paternity leave. A case shows that the company claims that employees have taken paternity leave and no longer enjoy annual leave, which lacks legal basis, and judges to pay employees the salary of unused annual leave; In another case, the enterprise has paid the employee the normal attendance salary during the paternity leave, and the employee asked the enterprise to pay additional economic compensation for the paternity leave, which is groundless in law.

In view of the salary payment during paternity leave, during the two sessions of Beijing this year, the sector proposal submitted by the Beijing Federation of trade unions called for changing the salary of employees during paternity leave from “paid by the employer” to “paid by the maternity insurance fund”, so as to reduce the economic burden of employers.

In addition, the reporter noted that the laws and regulations applicable to maternity leave and paternity leave are different, which is reflected not only in the level of laws and regulations, but also in the degree of illegal punishment to enterprises.

“Rigidity” should also be enhanced

In addition to the issue of salary payment, experts believe that whether paternity leave is “rigid” and whether the leave days and relevant treatment are unified also affect the actual implementation of paternity leave.

“The setting of paternity leave enables male and female employees to be treated in a balanced manner on the issue of maternity leave, which helps to reduce employment discrimination against women.” Shen Jianfeng said.

However, in the investigation, Shen Jianfeng found such a situation: some enterprises allow male employees to transfer the unused paternity leave to the woman as increased maternity leave. “In this way, it is easy to aggravate the employment discrimination against women, which deviates from the original intention of setting paternity leave, and the mandatory paternity leave should be increased.”

During the national two sessions this year, Lu Xin suggested extending male paternity leave. In her view, the increase in the difference between the number of days of maternity leave and paternity leave between men and women will further increase the impact of childbirth on the work of male and female workers.

“The difference in the written expression of the provisions of each province has left operating space for the enterprise, which may affect the treatment of employees such as full attendance bonus and year-end bonus.” In Shen Jianfeng’s view, the differentiation of local regulations is not conducive to the implementation of the system. The setting of the length of paternity leave should be similar to the maternity leave mode, that is, the number of days and standards across the country are relatively unified, and there is a certain floating space according to the actual situation.

Mi Fu (1051-1107), whose initial name was Fu, with a Chinese character seal, was named lumen resident and Xiangyang Manshi, and later changed its name to Fu. His ancestral home was Taiyuan and later settled in Runzhou (now Zhenjiang, Jiangsu). Mi Fu is good at calligraphy and painting, proficient in the art of identification and fond of collection.
