Where is the HowNet road?

However, the agent of HowNet believes that the compensation standard proposed by the plaintiff is too high. It said that even according to the relatively low compensation standard of “200 yuan / 1000 words” in Teacher Zhao Dexin’s case, the amount of compensation for the works in the library of HowNet now reaches 120 billion yuan. Even if there is fault or negligence in the use of HowNet, the benefit can not be so high. Therefore, the defendant cannot bear the compensation.

The case has not yet been decided. However, in addition to Chen Yingsong, Dou Yingtai, Wang Bisheng, Cai Jianwen, Tang Xiaoying and other writers also filed a lawsuit against HowNet on the ground of infringing the right of network communication of works information.

Liu Bin, a lawyer from Beijing Zhongwen law firm, told radar finance and economics that the compensation standard for copyright infringement is clearly stipulated in Article 54 of China’s copyright law, and in judicial practice, the amount of compensation is generally determined with reference to the provisions of the state on remuneration and the number of words.

Specifically, Article 5 of the measures for the payment of remuneration for the use of written works promulgated by the State Copyright Administration has provisions on the use of other people’s original works; For the adaptation, compilation and translation of works performed by others, a clear compensation standard shall be given, with a maximum of 80-300 yuan per thousand words. Therefore, the calculation method of yuan / thousand words meets the reasonable and legitimate standards stipulated by the law.

In response to HowNet’s claim that the amount of compensation is too high, Liu Bin said that in copyright infringement cases, the court determined that the amount of compensation losses mainly focuses on the losses suffered by the obligee and the profits of the infringer, and will be reviewed in combination with relevant laws and regulations, and will not take the ability to pay of the parties as the consideration for determining the amount of losses, At the same time, China’s relevant laws and regulations do not include the party’s ability to pay into the identification elements of the amount of copyright infringement compensation.

“After the court makes a judgment, the judgment has the res judicata and enforcement force to bind both parties. HowNet needs to execute according to the judgment of the court.”

However, Liu Bin also mentioned that when facing controversial cases, HowNet may take positive measures as much as possible, such as timely communication and negotiation with the other party, seeking out of court settlement, etc.
