Lewis gave a total of 45 articles of the Working Guide, divided into five areas, namely, general rules, the handling of criminal cases in intellectual property, the handling of civil and administrative proceedings, the handling of public interest cases.

The first is to clarify the scope of prosecution of intellectual property. Article 4 of the Work Guidelines provides that intellectual property cases include, inter alia, criminal offences against intellectual property, supervision of intellectual property civil proceedings, supervision of intellectual property administrative proceedings, and public interest litigation in intellectual property. On the criminal side, article 13 provides for the handling of competition or counts of offences in intellectual property criminal cases and penalties. With regard to the monitoring of civil and administrative proceedings, articles 26 and 35 provide for the scope of civil and administrative proceedings in intellectual property, depending on the subject and the type of case. Chapter IV of the Work Guidelines also provides for civil public goods and administrative public goods litigation in intellectual property. The second is to intensify criminal attacks against intellectual property rights. In order to further enhance the important role of the prosecution service in combating crimes against intellectual property, article 14 of the Working Guide provides for the improvement of mechanisms for cooperation with investigative oversight and collaboration of public security authorities. Article 15 provides for the conduct of criminal proceedings in intellectual property, with a focus on full chain punishment, and strengthens the efforts to combat connected crimes up to and downstream. Article 16 provides for criminal proceedings in intellectual property rights, which shall be strictly strict and lenient. Article 20 provides for the application of civil suits and civil public goods to be instituted by the prosecution. Criminal prosecution of preferential intellectual property continues through legal penalties for shocks.

The third is the strengthening of civil and administrative oversight of intellectual property rights. Due to the specific nature of the intellectual property technology cases and the anti-monopoly appeal mechanism, the supervisory level of the prosecution service is required, and article 23 of the Working Guide provides that the resistance and review of such cases shall be the responsibility of the Supreme People’s Procuratorate. In order to further implement the concept of precision supervision, article 25 makes clear the factors that need to be taken into account in intellectual property cases. Articles 31 to 34 provide for the scope of the review of different types of civil proceedings in intellectual property, such as copyright, trademarks, patents, etc. Articles 36 and 37 define the scope and principles for the supervision of cases in administrative litigation in intellectual property and provide basic oversight lines for the prosecution of intellectual property.

The fourth is a mechanism for addressing technical issues. In response to the highly technical characteristics of intellectual property cases, article VI of the Working Guide provides that persons with expertise or prosecutors may be invited to participate in the hearings, as required by the case. Article 7 provides for the legal hiring of persons with expertise or the assignment of a suitably qualified prosecutorial staff to address specific issues in the case. An opinion issued by the former section may be examined as a basis for the prosecution, the Prosecutor’s judgement in the use of evidence or the relevant decision. Article 8 provides that, where an intellectual property case is deemed to require identification, an accredited body may be commissioned.

The fifth is the construction of a work-to-work interface. In order to implement the concept of synergistic protection of intellectual property, the Working Guidelines provide for the prosecution to focus on mechanisms for dealing with cases relating to intellectual property between the prosecution service, the prosecution service and the public security authorities, the People’s Court, the executive branch, and the criminal justice system.
