RMB cash is the legal tender of the country. It is not only related to financial inclusion and the rights and interests of financial consumers, but also plays an important role in maintaining the stability of the financial system. The innovation of payment methods should be conducive to the smooth payment environment, the protection of people’s livelihood and the promotion of the public’s sense of happiness and access. Discriminatory or non convenient measures should not be taken to exclude cash payment, resulting in a “digital divide”. At present, the phenomenon of cash rejection occurs from time to time in society, and the rectification of cash rejection needs to be strengthened.

Make clear the nature of the charging and non cash receiving behavior of the business entity under special scenarios

In order to effectively safeguard the legal status of RMB and actively practice the concept of Finance for the people, the central bank issued the announcement of the people’s Bank of China ([2018] No. 10) in July 2018, which clearly pointed out that “no unit or individual shall refuse to accept cash by means of standard terms, notices, statements, notices and so on”; The announcement of the people’s Bank of China ([2020] No. 18) was issued in December 2020 to further standardize the receipt and payment of RMB cash.

Guo Xinming said that the current regulations on the administration of RMB stipulate the issuing subject, type and liquidity of RMB, but the regulations were promulgated in 2000. The background of the regulations is quite different from that at present. The ideas, principles and contents determined are no longer suitable for the development and changes of economy and Finance and the innovation needs in the field of payment, It can not meet the practical needs of RMB cash management in the era of digital economy. Therefore, in order to maintain the legal status and financial stability of RMB, further promote the rectification of cash rejection, and effectively protect the rights and interests of consumers in the use of cash, it is urgent to improve the laws and regulations related to the rectification of cash rejection as soon as possible from the perspective of top-level design, so as to provide legal support for the standardized and efficient rectification of RMB cash rejection.

It is noteworthy that the current laws and regulations are not clear about the nature of cash rejection. Guo Xinming said that the current laws and regulations have mandatory provisions on the issuing subject, type and liquidity of RMB, ensuring that there is a superior legal basis for the rectification and rejection of cash, but did not fully consider the special and accidental scenarios in cash circulation and use. For example, first, China’s cash circulation and voucher material distribution have strong regional characteristics, In some areas with strong preference for paper money, the public’s willingness to use coins is low; Second, in the case of large cash payment or malicious use of a large number of coins for payment, the trading party is easy to add restrictive terms due to risk considerations; Third, the use of damaged and defaced RMB for payment, and the trading party refuses to accept it out of the protection of its own reasonable rights and interests. The unified rejection of damaged currency, coins, large amounts of cash and other special scenes as cash rejection behavior is not conducive to purifying the RMB circulation environment and does not comply with the spirit of fairness and justice of the law.

He further said that in order to ensure that the rectification of cash rejection is practical, on the premise of fully considering the legitimate rights and interests of consumers, on October 22, 2021, The central bank issued the punishment of the people’s Bank of China for rejecting RMB cash in the third quarter of 2021, which stressed: “rejecting incomplete and defaced RMB, dimes, coins and other acts belong to the lack of service awareness or service level of merchants, and should not be defined as the illegal act of rejecting cash.” Although the above provisions reflect the “temperature” of administrative law enforcement and practice the concept of Finance for the people, they lack the necessary basis of laws and regulations, so it is difficult to obtain the understanding of the rejected object, which is very easy to increase the risk of duty performance.

Guo Xinming suggested that the scope of cash rejection should be clearly defined in laws and regulations. It is suggested to sort out the special and occasional scenes of rejecting RMB cash, and clearly define the charging and non cash receiving behavior of business entities under special scenes in the regulations on the administration of RMB, so as to provide a rigorous legal basis for the rectification of rejecting cash. Timely discuss the monetary legal compensation system, refer to the quota management experience of other countries and regions in the world, and consider adding “coin payment limit” and “cash transaction limit” to avoid the situation that the transaction party rejects cash of certain material, type and quantity “reasonable but illegal”.

Standardize the cash payment behavior under the new business mode in the form of laws and regulations

Is it one size fits all to reject cash? The answer is, of course, No.
