In recent days, the General Directorate of State Market Supervision has issued the Guide to the Marking of Foods for Special Medical Purposes, not only as an important initiative for the safe regulation of food formulations for special medical purposes, but also as an important step in the development of the special medical formulation food industry, which will serve as a basis for the future smooth and healthy development of the industry.

Guidelines for labelling and labelling of special-medical foods (hereinafter referred to as special-health foods) to guide medical doctors, clinical nutrients and consumer science in the rational use of special-health foods have recently been published by the General Inspectorate of the National Market Supervision (CNS) (hereinafter referred to as the Guide).

The Guide has refined 13 content and main exhibit content of the special-health food labelling and description of the product name, product category, distribution table, nutrient composition form, etc., and has also made clear the “prohibition requirement” of the special-health food labelling and narrative, which prohibits the use by the enterprise concerned of false, exaggerated terms, including “permissive” in product promotion, to avoid misleading consumer behaviour.

The in-service evaluation noted that the publication of the Guide was not only an important initiative to regulate the safety of special-health foods, but also an important step in the normative development of the special-health food industry, and would serve as a basis for the future smooth and healthy development of the industry.

Strengthening of marking and labelling management

Specialized foods are those formulated for the purpose of satisfying the special needs of the dietary population, the disincentives, metabolic disorders or specific diseases for nutrients or meals, specially processed for formulation, which must be used by physicians or clinical nutrients. Frequently well-known special-health foods include those for special medical applications from the age of 0 to 12 months, as well as those for special medical applications that apply to persons over 1 year of age, such as digestive surgery patients, inclination therapy patients, diabetes patients and kidney dialysis patients.

In terms of the strictness of the country’s relevant regulatory regulations, special-health foods are seconded to medicines, far higher than general foods and health-care foods. The strengthening of market regulation for special-health foods begins with the strengthening of the regulation of labelling.

The Guide stresses that special medical food markings should be consistent with the relevant laws, regulations, regulations and national standards for food security, and that, where the content of the certificate for the registration of medical foods is concerned, it should be consistent with the content of the certificate of registration. The labels, statements requiring special medical foods should be authentic, scientifically accurate, easily understood and easily identifiable, and must not contain false, exaggerated or absolute language.

The Guide systematically summarizes 13 elements that need to be identified in the special medical food labelling and description book, clarifies the typology requirements of the business for product names, commodity names and trademarks, specifies the requirements for clinical testing of specific nutrient-based food formulations, proposes a typology and alerts.

In response to the complexity of the main exhibiting content of some of the current products, which is not conducive to a clear identification of consumers, the Guide makes clear the main presentation of the subject matter, and for the first time proposes that the smallest distribution package of special-health foods be marked as a “minimum blue flower” for the exclusive purpose of special-health food products. Markings should be marked at the upper or right corner of the main display of the label, which can vary according to the pattern. Non-specialist foods must not be counterfeited or used as medical food markings.

With the socio-economic development of our country, the growing health needs of the population and the growing number of ageing social groups, the health-care food industry is in a fast-track process.

The Guide issued by the General Directorate of Market Regulation is a technical guidance document designed to regulate the labelling of special-health food enterprises, to guide the rational use of physicians, clinical nutrients and consumer science, and to further enhance social awareness and identification of special-health food products.

The Executive Vice-President of the China Nutritional Health Food Association introduced the report that the Guide clearly identifies the use of the “blue flow” for the exclusive marking of special-health foods and provides a “identified mark” for the location, use and awareness of special-health foods. The Guide was developed and published not only by the General Directorate of Market Supervision, which implements the “four most stringent” requirements, but also by making practical and important initiatives to regulate the safety of special-health foods, but also by the regulation of the special-health food sector, which forms the basis for the future smooth and healthy development of the industry.

Avoiding false exaggeration

The first case of special-health food in the world was born in the United States of America in the 1950s for p苯one urine treatment. Many developed countries have then begun to make extensive use of special-health foods to address the nutritional uptake of infants and young children and have put in place strict regulatory measures and standards for their use.

The current special-health food industry in my country is still at a very early stage of development, but there are very large groups of people with special nutritional needs in the country, and the existing special-health foods are not able to meet market needs. The special-health food market, “fishing is mixed”, is particularly volatile.

In May 1950, the Department of Market Regulation of the Yellow Island City Department in the Province of Shanxi Province verified the violation of the media’s disclosure of “solid beat flour in the yard of the Beijing hospitals” by the business-related business of the Young Island COMPAL.

In May 2020, the General Directorate of Market Regulation specifically tasked the Market Regulatory Department of the Province of Lakenan to conduct a thorough examination of cases of suspected consumer fraud and to publish the results of the survey in a timely manner to the community of child-friendly mother and child shops in the Luong Province of Lakenan, where the media were revealed. Ultimately, the Superintendent of the Endangered County Market has made an administrative penalty of up to $2 million for the operator, and the 63 clients have been compensated for nearly 0.3 million.

In August 2021, the South Shan Regulatory Authority of the City of Guangxi Province imposed an administrative penalty of $145,257 million and a fine of $284.62 million for offences such as the operation of undefined foods (solid beverages), the failure to establish a food marketing record system, the failure to maintain relevant sales documents.

In recent years, there have been many cases of special-health food sanctions, the main characteristics of which are, in aggregate, ambiguous descriptions of the composition of the special-health food product or “coltan” fish.
