Eight departments jointly issued a document to explicitly prohibit such internships in vocational schools!

Recently, the Ministry of education, the Ministry of industry and information technology and other eight departments issued the newly revised regulations on the management of internships for students in Vocational Schools (hereinafter referred to as the regulations), which delineated the “red line” of internship management, made it clear that simple and repetitive labor and high-intensity labor unrelated to major should not be arranged, and “illegal organization of internships for profit-making purposes is strictly prohibited”, Make it clear that the internship unit should give students appropriate internship compensation.

The eight departments deeply analyzed the new situation of post upgrading and career scene changes under the background of digital economy, and revised the regulations on the management of student internship in vocational schools issued and implemented in 2016, focusing on the whole process of internship and focusing on key links.

The regulations put forward one “no” and 27 “no” for the problems of inappropriate internship contents, compulsory internship, paid internship, simple and repeated labor, participation of intermediary institutions, illegal arrangement of overtime and night shift, and made clear the handling regulations to effectively protect the legitimate rights and interests of internship students.

The regulations specify that the internship content “shall basically cover the typical work tasks of the corresponding posts (groups) of the major, and in principle, internships shall not be arranged across major categories” and “students shall not be arranged to engage in physical labor with grade III intensity or above or other internships harmful to physical and mental health”.

In view of the problem of compulsory internship, the provisions further guarantee the right to know of students and parents, and make it clear that all students participating in the uniformly organized on-the-job internship should obtain the informed consent signed by students, student guardians or parents. If students and their legal guardians or parents clearly disagree with the school internship arrangement, they can choose the qualified on-the-job internship unit by themselves. Vocational schools shall not be forced to arrange students to practice in designated units, and shall not detain students’ student cards, resident identity cards or other documents.

At present, intermediary agencies involved in internship to earn “head fee” is an important source of compulsory internship and paid internship. The regulations specify that the tripartite agreement on internship must be signed by vocational schools, internship units and students, and reiterate that it is not allowed to organize, arrange and manage students’ internship through intermediaries or paid agents.

In addition, on the basis of the original prohibition of “arranging students to work overtime and night shift”, the regulations further add the requirements that internship units should abide by the national regulations on working hours, rest and vacation, and ensure that students have the rights to rest and vacation, obtain labor health and safety protection, and receive technical skill guidance during on-the-job internship.

In view of the internship remuneration and expenses of students, the regulations specify that the internship unit shall give students appropriate internship remuneration, which shall not be less than 80% of the salary standard of the same position or the lowest salary standard of the unit in principle, and the payment cycle shall not exceed 1 month. It shall not be paid with goods or vouchers instead of currency or forwarded by a third party, and shall not collect internship deposit from students Training fees, commissions on internship remuneration, management fees, internship materials fees, employment service fees or other forms of internship fees shall not require students to provide guarantees or collect students’ property in other names.

In addition to setting a “red line” for internship management, there are four other major amendments to the regulations. First, it further emphasizes the nature of practice, optimizes the connotation and boundary, and unifies “on-the-job practice” and “on-the-job practice” into “on-the-job practice”. At the same time, it puts forward that qualified productive training bases, factory lieutenant colonel, school factory and virtual simulation training bases can be used as practice units; Second, the list of internship units shall be reviewed by the party organization at the school level and made public. In case of emergencies or major risks during internship, classified management and control shall be carried out according to the requirements of territorial management; Third, promote the deep integration of internship into school enterprise collaborative education, and support the cooperative exploration of various forms of practical teaching reform in combination with apprenticeship training and through training in secondary and higher vocational colleges; Fourth, strengthen the coordination between departments and local governments. It is required that the inter provincial internship must be approved by the competent department of the school in advance and reported to the competent department of the provincial level for the record according to the procedures.

It is reported that in the next step, the Ministry of education will work with relevant departments to further unblock the channels of policy consultation and situation reflection, and seriously deal with and jointly punish the vocational schools, internship units and relevant responsible persons who violate the provisions in accordance with the law.
