一个名叫OOKI DAO的组织，上周收到了美国大宗商品期货交易委员会的起诉材料，该大宗商品期货交易委员会状告OOKI DAO提供非法保证金交易和借贷服务。最有意思的是，这个起诉材料是通过OOKI DAO的会员论坛以及官方网站上的咨询服务机器人提交的。且不说这个诉讼材料的送达方式是否合法，但显然有一点是可以确定的，DAO的组织架构显然也免不了承担法律责任。 DAO是Decentralized Autonomous Organization的缩写，去中性化自治组织，所谓的去中心化自治组织，他与公司或其他合法成立的实体不一样，后者是合格的法律主体，可以单独承担法律义务，享受法律保护的权利，而DAO目前的法律属性还不明确，绝大部分国家的法律也没有对DAO的法律地位给出清晰的界定。既然DAO的法律属性不明确，绝大多数国家也没有承认DAO是一个合格的法律主体，那么让DAO去承担法律责任可能是有问题的，也鉴于这样的原因，很多人认为可以利用DAO的形式为所欲为，甚至以DAO的形式开展非法业务。但如果认为可以借助DAO的形式进行各种违法违规业务甚至是犯罪活动显然这也不可能被各国法律或监管机构所允许...
