Donald Trump has wasted multiple chances to return all classified government documents to date, House Oversight and Reform Committee chair Carolyn Maloney said on Tuesday in a letter demanding the former president certify — in writing — that he's handed over all pertinent presidential records.

"The Committee is concerned that, given this pattern of conduct, Mr. Trump may continue to retain presidential records at non-secure locations, including classified material that could endanger our nation's security and other important records documenting Mr. Trump's activities at the White House," Maloney wrote to National Archives and Records Administration officials.

"I urge NARA to seek from former President Trump a written certification that he has surrendered all presidential records or classified materials, has not made any copies or reproductions of such materials, and has not transferred any records or government documents to any party other than NARA or DOJ since his term ended," she added.

Maloney wrote that Trump could have avoided the ongoing legal fight sparked by last month's raid at Mar-a-Lago at several points along the way. Among the instances she cited: when he left the White House in January 2021, after NARA asked about missing documents in May 2021, and after a grand jury subpoena issued in May 2022.

"NARA's staff recently informed the Committee that the agency is not certain whether all presidential records are in its custody," Maloney wrote of the ongoing confusion that reportedly came up during an August 24 call between the oversight panel and NARA personnel.

She added that NARA should conduct an "urgent review" of any and all Trump-related records that are unaccounted for and report back to the oversight committee by no later than September 27.

Maloney's call for accountability comes as Trump and the Justice Department are working on adding a court-appointed special master to the mix to help sort out any privilege arguments. A leading contender appears to be former federal judge Raymond Dearie.
