(b) If the dispute cannot be resolved within sixty (60) days from the time that you contact Moledao Pte Ltd, the dispute shall be submitted to the Singapore Mediation Centre for resolution by mediation in accordance with the Mediation Procedure of the Singapore Mediation Centre for the time being in force. You agree to participate in the mediation and undertake to abide by the terms of any settlement reached.
(c) If the mediation is unsuccessful, the dispute shall be exclusively referred to binding arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre in force at such time, which rules shall be deemed to be incorporated by reference into these Terms. The tribunal shall consist of a sole arbitrator. The seat of arbitration shall be Singapore and the language to be used in the arbitral proceedings shall be English.”
A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of these Terms.
Severability and Waiver
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
