The next day, Mr. Zhuang developed mild diarrhea and did not seek medical treatment because of his mild symptoms. A few days later, the staff of the milk tea shop contacted Mr. Zhuang to apologize and expressed their willingness to compensate Mr. Zhuang 150 yuan with 10 times the price as a reference, which was rejected by Mr. Zhuang.
Mr. Zhuang believes that the milk tea is sealed and packaged when it is handed over to him, and he only drinks it by inserting a straw. Therefore, Mr. Zhuang claimed that the behavior of the milk tea shop violated the relevant provisions of the food safety law and demanded compensation of 1000 yuan.
The milk tea shop argued that it was impossible for flying insects to enter the cup during the production of milk tea. The raw materials of “black tea latte” are only black tea and canned milk. The cup sealing machine can complete the sealing action in a few seconds, and the clerk needs to shake the cup and wipe it after sealing. If there are insects in the whole production process, the clerk can find them on the spot.

After hearing, the Shanghai Pudong court held that the plaintiff Mr. Zhuang claimed that there were flying insects in the drinks produced by the defendant and provided corresponding evidence. Although the defendant denied this, it lacked strong evidence support. Therefore, the Court confirmed the facts claimed by the plaintiff. The milk tea shop did not strictly fulfill the responsibility of food safety production in the process of making drinks on site, and did not timely find the entry of flying insects in the prepared drinks, which belongs to the production of food that does not meet the food safety standards.
According to the second paragraph of article 148 of the food safety law of the people’s Republic of China, if a consumer produces food that does not meet the food safety standards or operates food that knowingly does not meet the food safety standards, in addition to claiming compensation for the losses, the consumer may also claim compensation of ten times the price or three times the losses from the producer or operator; If the amount of additional compensation is less than 1000 yuan, it shall be 1000 yuan. Therefore, the plaintiff asked the milk tea shop to compensate 1000 yuan, which was supported by the court.
