The revised standard for filing and prosecution (II) has revised and improved the standards for filing and prosecution of 21 cases according to the amendments of laws and judicial interpretations. Among them, the standards for filing and prosecution of securities and futures criminal cases have been comprehensively and systematically revised to further strengthen the crackdown on crimes such as fraudulent issuance of securities, illegal disclosure and non disclosure of important information, so as to protect the legitimate rights and interests of investors. According to the revised standard for filing and prosecution (II), those who fraudulently issue stocks or company, enterprise bonds, depositary receipts or other securities recognized by the State Council according to law, resulting in an accumulated direct economic loss of more than one million yuan shall be filed and prosecuted.
The revised standards for filing and prosecution (II) has adjusted the standards for filing and prosecution of 25 cases in combination with the judicial interpretation being studied and drafted by the “two Supreme People’s courts” recently. Among them, the duty crimes committed by non state functionaries are subject to the same criminalization criteria as those committed by state functionaries, which clearly stipulates that “personnel of companies, enterprises or other units who take advantage of their positions to illegally occupy their own property, with an amount of more than 30000 yuan, shall be filed for prosecution”, and all kinds of market subjects such as state-owned enterprises, private enterprises, domestic and foreign capital, small, medium and micro enterprises shall be given the same judicial protection, Fully embody and implement the spirit of the times of equal protection of property rights.
